For some businesses, neither growth nor expansion is on the horizon. Rather, consolidation, restructuring, and bankruptcy proceedings are the order of the day. While we use the term bankruptcy or creditors' rights to describe our practice, it is not a complete picture of what we do. Johnston Barton has extensive experience guiding companies, creditors (secured and unsecured), landlords, and others affected by insolvency through the intricacies of bankruptcy filings, out of court workouts and commercial litigation. Our practice is not limited to Alabama. Our lawyers regularly appear in courts throughout the Southeast and other parts of the country in the furtherance of their client’s interests.

We represent clients in breach of contract actions, breach of promissory notes, enforcement of security interests or agreements, lease litigation, foreclosures, receivership proceedings, fraudulent conveyance claims, replevin actions, suits to enforce judgments, lender liability claims, preference claims, and all types of contested bankruptcy proceedings. We also provide counsel on alternatives to bankruptcy such as out of court workouts and loan restructuring, compositions, assignments for the benefit of creditors, and non bankruptcy liquidations.

We have significant experience representing Unsecured Creditors Committees in bankruptcy proceedings.
