Toxic Torts : Litigation

Johnston Barton has considerable experience in toxic tort cases. Our team of knowledgeable litigators assists our clients in addressing the demands of this type of litigation.

We have represented various defendants, including manufacturers, suppliers and other companies, defending claims brought by plaintiffs in both state and federal courts. These claims include contentions that plaintiffs have suffered respiratory injuries due to the inhalation of one or more components of a glue used to secure the roof in underground mines; that plaintiffs have been poisoned by chromated copper arsenate injected into pressure-treated lumber; that plaintiffs have suffered personal injuries as a result of emissions from foundries; and that plaintiffs have sustained injuries arising out of toxic spills involving railroad cars. Johnston Barton is also presently defending a client in one of the largest toxic tort cases in the State of Alabama, pending in the Circuit Court for Tuscaloosa County and consisting of more than 1,500 plaintiffs.

Johnston Barton’s reputation for commitment to the highest quality of work on behalf of our clients holds true for the lawyers devoting a significant portion of their time to toxic tort cases. Johnston Barton lawyers rely on their extensive knowledge of and substantial understanding of the applicable laws and precedents in the toxic tort context to effectively represent and defend our clients. We also appreciate and take into consideration the need and desire for prompt and efficient resolution of claims, and, where appropriate, engage in mediations and settlement negotiations to strive for the most beneficial and cost-effective outcome for our clients.
